Terms & Conditions1. General Agreement
1.1. These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the System and the installation.
1.2. Availability at the start of an agreement: If for any unfortunate reason the smart home system cannot provide the services in your home in an agreement by the start date, We will have no liability to You for any loss or damage but You may ask for a replacement for the faulty smart home products (subject to availability).
1.3. SERVICE MAINTENANCE: SO THAT WE CAN MANAGE YOUR SMART HOME EFFECTIVELY AND ENSURE SEAMLESS CONTINUITY OF THOSE PRODUCTS AND SERVICE, CUSTOMER ARE ENTITLED TO SERVICE MAINTENANCE AND PRODUCT WARRANTY FOR 1 YEAR. OUR CONSULTANT WILL FOLLOW UP EVERY 3 MONTHS FOR A YEAR TO MAKE SURE THAT THE SMART HOME IS TO YOUR REQUIREMENT.
1.4. We may elect not to renew an agreement. If so, We will inform You by email, following the same notice periods specified above.
1.5. Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company. The Company has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.
1.6. The extent of Our liability: To the maximum extent permitted by applicable law, We are not liable to You in respect of any loss or damage You suffer in connection with an agreement, including without limitation any loss or damage arising as a result of our failure to provide a service as a result of mechanical breakdown, strike or another event outside of Our reasonable control otherwise unless We have acted deliberately or have been
negligent. In no event shall We be liable for any loss or damage until You provide written notice and give Us a reasonable time to put it right
1.7. Invoicing and Payments: You will provide Us with valid and updated documents that Are reasonably acceptable to us.
1.8. Overdue Penalty: If any invoiced amount is not received by Us by the due date, then without limiting our rights or remedies. The penalty will cause You to lose the product You purchased as We will recall all of our products. We may even consider taking legal action towards this if the amount overdue by You is not made payable to Us in 10 business days
2. USE OF THE SMART HOME SYSTEM
2.1. Installations: We take great pride in Our electrical installation and its upkeep and therefore You must not install any cabling or wiring that could interfere with the smart home system without Our consent, which We may refuse in our absolute discretion. As a condition to Our consent, You must permit Us to oversee any installations (for example cabling or electrical systems that could cause the smart home system to be unstable) and to verify that such installations do not interfere with the use of the smart home system. Fees for installation and de-installation will be at Your cost.
2.2. Data protection: You acknowledge that We may collect and process personal data from You as strictly necessary to ensure compliance with applicable laws and regulations and to enable Us effectively to provide services to You. You acknowledge and accept that such personal data may be transferred or made accessible to other entities in our group, wherever located, to provide the services, in each case under all applicable data protection legislation.
2.3. Confidentiality: The terms of an agreement are confidential. Neither of us may disclose them without the other’s consent unless required to do so by law or an official authority. This obligation continues for 3 years
after an agreement ends.
2.4. Assignment: An agreement is personal to You and cannot be transferred to anyone else without prior consent from Us unless such transfer is required by law. However, We will not unreasonably withhold our consent to
an assignment to an affiliate provided that You execute our standard form of assignment. We may transfer any agreement and any amounts payable by You under an agreement to any other member of Our group.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice before any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the products and the service
Return and Refund Policy
This Return and Refund policy shall only be applicable for online delivery shopping via smarthomebuddy.com.my only.
We shall use our best efforts to ensure that Orders are correctly fulfilled. Should there be any discrepancy of Products delivered and the Customer wishes for return and refund, please contact us within seven (7) days upon receiving the Products. We will contact the Customer within seven (7) days to direct the Customer of the procedures in respect of the return of Products and refund. The Customer is advised to wait for our instruction for the next course of action. In the event the Customer does not receive any reply from us after the aforesaid period, please contact us either by e-mail at firstname.lastname@example.org
If the Customer opts for replacement or exchange of Products, the affected Products MUST be returned in person to our Smart Home Buddy office. No replacement or exchange of Products will be entertained if the Products are returned via courier or post. All replacements or exchange of Products shall be effected subject to stocks availability.
- Return/Exchange of Products or refund can be arranged under the following reasons:
|Provided Always that the Customer shall return or caused to be returned to Smart Home Buddy the aforesaid Products unused and in its original condition, quantity and packaging as it is first delivered to the Customer together with the proof of Order, payment and delivery of the Products.|
If a Product which was ordered and invoiced is not included in the delivery, Smart Home Buddy shall either refund the Customer the value of that Product, or replace the Product.
If any Product which was not included in the Customer's Order is delivered to the Customer, Smart Home Buddy shall collect the Product from the Customer.
If the Customer has been charged for a Product which has not been delivered, Smart Home Buddy shall refund the Customer the value of the Product as originally charged to the Customer.
If a Customer is charged more than the value of a Product as displayed on the site when the Customer makes its Order, Smart Home Buddy shall refund to the Customer the difference.
The return of a Product by a Customer does not automatically warrant for a refund. Smart Home Buddy will inspect the returned Products upon receipt of the same. If the conditions in Item No. 4 of this Return and Refund Policy have been fulfilled, refund will be made to the Customer and we will reimburse the Customer of its courier charges for returning of the Products to us provided always that the courier payment slip is furnished to us upon seeking refund.
- All refunds will be made via the same mode of payment within 2 months and depending on the appointed bank refund policy in which your receipt of the refund will depend on the period of time your financial institution takes to finalise the refund. Smart Home Buddy shall not be liable with respect to any loss, damage, cost or expense that you or any person may incur as a result of any delay in your financial institution processing the said refund
- All deliveries are only within Malaysia. Street names and POS code must be correct and accurate.
- NO P.O. Box or International addresses.
- If the packaging seal is opened or damaged, DO NOT accept the parcel.
- If you are not at home to receive your purchased order, Please contact the carrier service (courier service) within a stipulated timeframe for next deliveries or pick up.
- If the order is not collected within the stipulated time, the order may be disposed and there shall not be any refund for the amount purchased for that order.
- We only use standard packaging materials for all orders.
- We deliver each order to one delivery address within Malaysia.
Delivery Lead Time
- Order confirmation and closing time is before 12 pm from Monday to Friday (except public holidays and considered the next business working day where applicable).
- Confirmed orders will be processed within the next four (4) business working days, excluding Saturday, Sunday & public holidays.
- Delivery lead time for Orders to arrive (after processing and packing) is as follows :-
- Peninsular Malaysia : 7 - 8 business working days.*
- Sabah & Sarawak : 8 - 10 business working days.*
